Terms of Service
These Terms govern your use of Sigmon Cloud, the managed service operated by Sigmon ("Sigmon", "we", "us"). By creating an account or using the service you agree to them. Questions: [email protected].
1. The service
Sigmon Cloud provides a dedicated, managed instance of the Sigmon telemetry platform (errors, product analytics, traces, LLM calls, feedback and related features) with the Cloud Pro feature set, managed backups with point-in-time recovery, and email support. Self-hosted use of the Community edition is governed by its own license (Elastic License 2.0), not by these Terms.
2. Accounts
You must provide accurate information, keep your credentials secure, and are responsible for activity under your account. You must be at least 18 years old and able to enter a binding contract, or act on behalf of a company that is.
3. Plans, fees and billing
- Cloud Pro costs US$49 per month or R$249 per month per instance. Annual billing is ten times the monthly price (two months free).
- Fees are charged in advance through our payment processor (Stripe) and renew automatically until cancelled.
- There are no usage or volume limits and no per-seat pricing for the Cloud Pro plan.
- Prices exclude taxes, which are added where required. We may change prices with at least 30 days' notice; a change applies from your next renewal.
- Refunds are described in our Refund Policy. In short: a 14-day money-back guarantee.
4. Cancellation
You can cancel at any time from your account. Cancellation takes effect at the end of the paid period. After cancellation your data is deleted as described in the Privacy Policy, 30 days after the cancellation takes effect. Export what you need before then.
5. Your data
You own the telemetry and other content you send to your instance ("Customer Data"). You grant Sigmon the limited right to host, process, back up and transmit it solely to provide the service. You are responsible for having the rights and legal basis to collect the data you send, and for configuring the SDK (including masking and consent) appropriately for your users. Our handling of personal data is described in the Privacy Policy and the Data Processing Addendum.
6. Acceptable use
You may not use the service to break the law, infringe others' rights, send malware, attack or probe the service or other customers, circumvent security or technical limits, resell the service, or send data you are not permitted to process (for example payment card numbers or health data without a written agreement with us).
7. Availability and support
We aim for high availability of the service and perform maintenance with reasonable notice where practical, but we do not guarantee uninterrupted operation unless a separate written SLA says so. Email support is provided at [email protected]. Ingestion endpoints may be rate limited to protect the service.
8. Suspension
We may suspend an instance for non-payment, material breach of these Terms, or to prevent harm to the service. Where practical we will notify you first and give a chance to fix the problem. During a payment suspension, ingestion may continue to be accepted for a grace period while reads and administration are restricted.
9. Intellectual property
Sigmon and its licensors retain all rights in the software and service. These Terms grant no rights in our trademarks. The browser and Node.js SDK is licensed separately under its own open-source license.
10. Warranty disclaimer
The service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
11. Limitation of liability
To the maximum extent permitted by law, Sigmon will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the service is limited to the fees you paid in the 12 months before the event giving rise to the claim.
12. Indemnification
You will defend and indemnify Sigmon against third-party claims arising from Customer Data or your breach of these Terms, to the extent permitted by law.
13. Changes to these Terms
We may update these Terms. For material changes we will give at least 30 days' notice by email or in the product. Continued use after the change takes effect means you accept it.
14. Governing law
These Terms are governed by the laws of Brazil, without regard to conflict-of-law rules, and disputes will be brought in the courts of Brazil, unless mandatory consumer law provides otherwise.
